You are bidding on used 1999 Sterling Semi Tractor w/Hydraulic 5th Wheel.  Vehicle was used primarily on our 6800 acre site for delivery of material to outlying locations.  Vehicle has 67,682 original miles.  Tires are in very good condition, air conditioner and heater work well.  You are highly encouraged to arrange for visit to our facility for test drive and visual inspection.  Please read and agree to our terms and conditions before placing bid. Both Export Control Letter and Citizenship Statement must be filled out before sale can be completed.Due Diligence:
-         Successful Bidder isrequired to supply transportation and is responsible for all related costs.  The Bidder should provide adequate trucks,dunnage, blocking, bracing and tie downs.  Seller will load assets onto the Bidder’s trucks.  FOB Fermi, freight collect.
 
-        Personal property purchased from the U.S.Government may or may not be authorized for   export from the United States to foreign country.  The purchaser must be United States citizen or permanent residentalien and/or if purchasing for company or corporation, the company orcorporation is United States owned company or corporation.  Purchasersmust complete Citizenship Self-Certification form and an Export Control andProliferation Sensitive Property Acknowledgement form.
 
-         All assets are listed and sold on “AS IS, WHERE IS AND WITH ALL FAULTS”conditions as of the date of sale and prospective bidders are advised toconduct due diligence research beforeplacing bids. “ALL SALES ARE FINAL”. Seller Warrants to the buyer that theproperty offered for sale will conform to its basic description. The propertymay contain flaws and/or defects may not be immediately detectable. Any claimfor misdescription must be made prior to removal of the property. If sellerconfirms that the property does not conform to the description, seller willkeep the property and refund any money paid.
 
-         The bidder is invited and urged to inspect the property prior tosubmitting bid. Property will be available for public inspection/pick-up atSite 38 Whse. #2 Fermi National Accelerator Laboratory, Batavia, Il..Inspection and pick-up may be made during weekdays between the hours of 7:30a.m. and 2:30 CST. 24-hour notification is required prior to coming to thesite by contacting the Property Office at (630)840-3585. Directions may beobtained from the Property Office.
 
-         Full payment is due within seven (7) calendar days from the end of theauction. Fermilab payment terms are: Any auction with winning bid under FiveHundred Dollars ($500) may be paid via Personal, business check, and certifiedchecks. Any auction with winning bidabove Five Hundred Dollars ($500) must be paid with Certified Check, CashiersCheck, or Travelers Check.
 
-         Removal: All items must be removedwithin 180 days from the time and date of auction closing. Purchases will bereleased only upon receipt of payment as specified. The buyer is responsiblefor all damage to Seller property and facilities caused during the loading andremoval of items. Property not removedwithin 180 days of the auction closing will be considered abandoned, buyer isdeclared in default and ownership shall revert back to the seller. Fermilabwill refund agreed upon purchase price of material if not picked up within 180days.
 
-         Vehicle Titles andEmissions: Properdocumentation (SF 97) will be presented to winning bidder upon pickup. It isthe buyers responsibility to apply for new title. Open SF 97’s cannot beissued, they must be in the name of winning bidder only. Vehicles do not havecurrent emission sticker. The purchaser is responsible for new emissionsticker if required.
 
-         Default: Default shall include (1)failure to observe these terms and conditions; (2) failure to make good and timelypayment; or (3) failure to remove all items within the 180 days. If buyer is indefault, Seller may negotiate with next closest bidder, re-list at anotherauction and/or pursue all legal proceedings. Default may result in terminationof the contract and suspension from participation in all future sales until thedefault has been cured. If the buyer fails in the performance of theirobligations, Seller may exercise such rights and may pursue such remedies asare provided by law. Seller may exercise the right to refund payments whereproperty has not been picked up by the buyer.

Personal property purchased from the U.S. Government mayor may not be authorized for export from the U.S. to foreign country.  If export is allowed, the purchaser is solelyresponsible for obtaining all required clearances or approvals.  The purchaser also is required to pass onthis information and any other DOE-provided export control guidance if theproperty is resold (including domestic transfers) or otherwise disposed.
 
Theuse, disposition and export of the property is subject to all applicable U.S.laws and regulations, including the Atomic Energy Act of 1954, as amended; theArms Export Control Act (22 USC 2751 et seq.); the Export Administration Act of1979 (560 USC Append 2401 et seq.); DOE Regulations (10 CFR Part 810);International Traffic in Arms Regulations (22 CFR 120 et seq.); ExportAdministration Regulations (15 CFR 730 et seq.); Foreign Assets ControlRegulations (31 CFR 500 et seq.); and the Espionage Act (37 USC 791 et seq.)which among other things prohibit:
 
The making of falsestatement and concealment of any material information regarding the use ordisposition, export or re-export of the property; and Any use or disposition,export or re-export of the property that is not authorized in accordance withthe provisions of this Agreement.  
PROLIFERATION SENSITIVE PROPERTY ACKNOWLEDGEMENT
 
In the event that proliferation sensitive property, asidentified on the U.S. Munitions List(22 CFR 121) or the International AtomicEnergy Information Circular (INFCIRC) 254 Part (the Trigger List), isinadvertently included in this sale, the purchaser agrees that the sale isvoid, and, if such property has been received by purchaser, that purchaser willreturn the property to DOE-Chicago Operations. If payment has been made, the purchase price only shall be refunded tothe purchaser.
